Terms & Conditions
Last updated: September 2, 2026
These terms are governed by German law. This English version is provided for convenience; the German version is authoritative.
1. Scope
These Terms & Conditions apply to all contracts between Flying Year, Unipessoal, Lda (“we”, “Onfuchse”) and its customers concluded via the website onfuchse.de — in particular for custom Shopware development work (agency services) and for use of the free customer account to obtain our Shopware plugins.
2. Agency services
The scope, duration and remuneration of individual development, plugin or consulting projects are agreed separately in a project-specific proposal or contract between us and the respective customer. These Terms apply in addition, unless otherwise agreed in the individual contract.
3. Customer account and free plugins
A free account registration is required to use our download area. Registration creates a free-of-charge usage agreement for access to our download area. There is no entitlement to registration; we reserve the right to decline registrations without giving reasons or to suspend accounts in the event of misuse.
You are required to provide truthful information when registering and to keep your password confidential. You are responsible for activity carried out using your credentials, unless you are not responsible for their misuse.
4. Plugin license terms
Unless stated otherwise on the respective product page, the Shopware plugins provided through the customer account are made available under the MIT license. The exact usage rights follow from the license text included with each plugin. Our end-user license agreement (EULA) applies in addition.
5. Availability
We aim to keep our website and download area available as uninterrupted as possible, but we do not warrant continuous availability, particularly during maintenance work or disruptions outside our control.
6. Liability
We are liable without limitation for intent and gross negligence, and in accordance with the Product Liability Act. For slight negligence, we are only liable for breach of a material contractual obligation (cardinal obligation) whose fulfillment is essential to the proper performance of the contract and on whose observance you may regularly rely; in this case, liability is limited to the foreseeable, typical damage. The free plugins are provided “as is”; liability for damages arising from their use is excluded to the extent permitted by law.
7. Changes to these Terms
We reserve the right to amend these Terms with effect for the future, to the extent required for legal or technical reasons. We will inform registered users of material changes in an appropriate manner, e.g. by email.
8. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship is Cascais, Portugal. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
